ADU Regulations in Portland: What You Need to Know

Portland is widely recognized as one of the most ADU-friendly cities in the United States. Progressive regulations, financial incentives, and a strong rental market make it an ideal environment for homeowners looking to add an accessory dwelling unit to their property.

Where Can You Build an ADU in Portland?

ADUs are permitted in most residential and mixed-use zones throughout Portland. This includes single-family residential zones (R5, R7, R10, R20), multi-dwelling zones, and commercial/mixed-use zones where residential use is allowed.

Size Limits

Standard ADUs: Limited to 800 sq ft or 75% of the main home's living area, whichever is smaller
Basement ADUs: Can be up to 1,000 sq ft
Two ADUs: Portland allows up to two ADUs on a single property under certain conditions

Parking & Owner Occupancy

Two of the biggest former barriers to ADU construction have been removed in Portland:

  • No parking required: Off-street parking is not required for ADUs
  • No owner-occupancy requirement: The property owner does not need to live in either the primary home or the ADU

The SDC Waiver Program: Save $36,000+

Portland's most significant financial incentive is the System Development Charge (SDC) Waiver Program. SDCs are fees on new construction that cover the impact on public infrastructure (parks, water, transportation).

How the SDC Waiver Works:

1. Sign a 10-year covenant with the City of Portland

2. Agree that neither the ADU nor the primary residence will be used as a short-term rental

3. SDC fees (potentially $36,000+) are waived entirely

Warning: Violating the covenant results in a penalty of 150% of the current SDC fees.

Permitting Process
